GENERAL TERMS AND CONDITIONS

1. Validity of the terms and conditions

These general terms and conditions (“GTC”) apply to all orders placed at Muse Rolling Sàrl. The version of the GTC published on the Muse Rolling Sàrl homepage (https://muserolling.ch/en/) shall apply and prevail over other versions.

Reference shall be made to Swiss substantive law where a matter is not specifically covered by the GTC.

2. Prices

All prices are given in Swiss Francs. Since Muse Rolling Sàrl is not subject to VAT, no VAT is charged.

3. Conclusion of the contract and payment

Any order placed by a customer shall be binding. The order will then be confirmed in writing, by e-mail, by Muse Rolling Sàrl. Upon confirmation of the order, a contract between Muse Rolling Sàrl and the customer will come into effect.

The delivery date will be confirmed by Muse Rolling Sàrl within 5 days from the order confirmation.

Specific design requirements by the customer will imply price variations.

4. Payment

Any ordered goods shall be paid by PayPal at the time of the order or, if authorized by Muse Rolling Sàrl, by bank transfer.

5. Delivery

Orders are sent worldwide. A delivery fee which varies depending on the country of destination is added to the price quoted on the website.

6. Retention of title

The delivered goods remain the property of Muse Rolling Sàrl until paid in full.

7. Cancellation

Since all goods are made to order, no cancellation shall be permitted by Muse Rolling Sàrl.

8. Warranty

Muse Rolling Sàrl warrants the delivered goods for a period of two years from the date of delivery. Warranty is limited to manufacturer’s defects in workmanship or materials. The warranty shall not be valid in the event of (i) improper use of the goods, or (ii) normal wear and tear, or (iii) modifications to the goods or improper assembly or repair by the customer, or (iv) use of the goods in sports competitions, or (v) defect caused by an accident or impact or (vi) use of the goods in non-compliance with road traffic regulations.

Any visible defect in the delivered good shall be notified to Muse Rolling Sàrl in writing, by e-mail, within 7 days from the date of delivery. Any other defect shall be notified to Muse Rolling Sàrl in writing, by e-mail, within 7 days from the date of discovery of the defect.

After returning the defective goods, the defect shall be rectified by Muse Rolling Sàrl and the goods will be shipped back to the customer in the shortest period reasonably possible. If no rectification of the defect is possible, Muse Rolling Sàrl will deliver replacement goods to the customer.

Any claim for a discount, conversion or compensation or any claim relating to any indirect or consequential damage is strictly excluded.

9. Data protection

All personal information provided by the customer is treated in strict confidentiality and in complicance with applicable law.

10. Data security

Appropriate security technology is used to protect customer data against unauthorized processing. However, no liability can be accepted for the security of the data transmitted on the Internet. The data is transmitted unencrypted.

11. Law and jurisdiction

All contracts concluded via the Muse Rolling Sàrl website are subject to Swiss law, excluding the provisions of the Vienna Convention on contracts for the international sale of goods. The place of jurisdiction shall be Canton de Vaud, Switzerland.
